Jurisdiction

The High Court Council:

  • elects judges to permanent judge's office;
  • rules on the termination of judges’ office;
  • proposes candidates to the National Assembly for the first time elected judges;
  • proposes to the National Assembly the election and dismissal of the President of the Supreme Court of Cassation and Court Presidents;
  • proposes candidates for judges of the Constitutional Court to the Supreme Court of Cassation;
  • appoints lay judges;
  • decides on the transfer, assignment, and objection to the suspension of judges;;
  • rules on incompatibility of other services and jobs with the judge's office;
  • rules in the process of the performance evaluation of judges and Court Presidents;
  • determines the composition, duration and termination of the mandate of members of disciplinary bodies, appoints members of disciplinary bodies and regulates the manner of operation and decision making in disciplinary bodies;
  • rules on legal remedies in disciplinary proceedings;
  • approves the in-service training program for judges and court staff, and monitors the implementation of the training program;
  • establishes the initial training program for judges;
  • passes the Code of Ethics;
  • determines the number of judges and lay judges for each court;
  • performs judicial administration tasks within its purview;
  • rules on issues of immunity of judges and members of the Council;
  • proposes the volume and structure of budgetary funds necessary for the work of the courts for overhead expenses, and oversees disbursement of funds in accordance with law;
  • rules on objections in the process of the election of Members of the Council from the rank of judges;
  • forms its working bodies and permanent and ad hoc committees, and elects their members;
  • provides opinions on amendments to the existing or on the passing of new laws which regulate the status of judges, organization and actions of the courts, as well as other systemic laws applied by courts or of importance for exercising judge's office;
  • rules on the existence of conditions for compensation for damages due to illicit and improper work of a judge;
  • submits annual reports on its work to the National Assembly;
  • performs tasks in respect of the implementation of the National Judicial Reform Strategy within its purview;
  • informs the public on its work;
  • collaborates with Court Councils from other countries and with international organizations;
  • passes acts envisaged by law;
  • performs other duties as specified by law..
